Identity and Forgery Offences) Act 2009

How can the Law protect Australian Citizens from the ABC?

Unfortunately for the people of Australia the law apparently does not protect them from the ABC. Now the ABC is doing what it did with the Carbon Emissions debate (Carbon Tax debate) with a Budget debate, by deliberately avoiding discussion of the potential impacts of population growth on the Budget. Australia has no population policy and this is directly related to the ABC's refusal to question politicians on the relationships between Emissions Growth, Budget Growth and Population Growth. Instead of holding politicians accountable the ABC colludes with them to suppress development of coherent population policy by using insane and unlawful population growth denial.

The following extracts from the [20-110] Crimes Amendment (Fraud, Identity and Forgery Offences) Act 2009 seem particularly relevant to the ABC's conduct.

Comments I have made (in brackets) appear relevant to use of fraud in supporting the passage of the Carbon Tax by concealing the truth about population growth’s impact on emissions growth. By dwarfing the impact of the Carbon Tax, the exposure of the population growth issue would have weakened the pro Carbon Tax argument. Therefore ABC broadcasting on this subject was arguably a deliberate criminal act of fraud because it strengthened the Carbon Tax argument using misleading information that influenced both the public and the politicians who voted for the Carbon Tax.

The letter of the law states that deliberate, premeditated misrepresentation aggravates the criminality of a fraud. The ABC's omission of the relevance of population growth to carbon emissions was so consistent that surely it was deliberate? The suggestion that criminal acts of fraud are not being perpetrated against the Australian people must be very difficult for any layman (like me) to understand. Please consult a lawyer for advice on the validity of these observations...........(See comments in brackets below)

[20-110] Crimes Amendment (Fraud, Identity and Forgery Offences) Act 2009

The Crimes Amendment (Fraud, Identity and Forgery Offences) Act 2009 (repealed) commenced on 22 February 2010. It introduced various new offences, some of which are described below.

Offence of fraud

Section 192E contains the offence of fraud, making it an offence for a person, by any deception, to dishonestly obtain property (misappropriation of money for a hair-brained Carbon Tax that incorporated a plan to send billions overseas to buy dodgy carbon credits) belonging to another or obtain any financial advantage (ideologically driven greed gratified by achieving Carbon Tax "victory") or cause any financial disadvantage (billions of dollars exiting the country on dubious grounds due to suppression of transparent public policy debate?). The maximum penalty is 10 years imprisonment.

Section 192F makes it an offence to dishonestly destroy or conceal any accounting record (direct correlation between 32% rise in fossil fuel based emissions and 32% rise in population between 1991 and 2011) intending to obtain property belonging to another (the Carbon Tax), obtaining a financial advantage or causing a financial disadvantage (to those who opposed the Carbon Tax on reasonable grounds). The maximum penalty is five years imprisonment.

Section 192G makes it an offence to dishonestly make or publish, or concur in making or publishing, any statement that is misleading in a material particular (deliberate omission of the extent emissions growth driven by population growth were predicted to exceed emissions reductions that might be achieved by a Carbon Tax) intending to obtain property belonging to another or obtain a financial advantage or cause a financial disadvantage (the ABC's deliberate, consistent, dishonest suppression of carbon emissions facts over a period of 6+ years leading up to the Carbon Tax). The maximum penalty is five years imprisonment.

Is this an example of fraud?
